11 GHz Bids

In the 11 GHz auction NPT have received a bid of NOK 6 000 500 for spectrum licence 1 and a bid of NOK 4 000 500 for spectrum licence 2 from Telenor Telecom Solutions AS. NPT received a bid which was rejected because it was handed in to late. The identity of the bidder whose bid was rejected will not be published. NPT did not receive any other bids.

Complaint - Auction design

Thursday 12 May 2005 NPT received a complaint from Telenor Telecom Solutions AS on the design of the auction rules for the 11 GHz auction. The complaint is available here (Norwegian only). By the letter 19 May 2005 NPT have reject the complaint from Telenor Telecom Solutions AS. The rejection of the complaint is based on procedural rules. The NPT rejection is available here (Norwegian only). NPT received 24 May 2005 a complaint from Telenor ASA on the NPT rejection of 19 May 2005 of the complaint from Telenor Telecom Solutions AS of 12 May 2005 . By the letter 26 May 2005 NPT have handled the complaint from Telenor ASA. The Telenor ASA complaint and the NPT response letter are available here (Norwegian only).

NPT have partly rejected the complaint from Telenor ASA and partly upheld our rejection of the complaint from Telenor Business Solution AS. Furthermore, NPT have decided to go through with the 11 GHz auction in accordance with the auction rules and time frame set out in the auction rules.

Time of auction and auction format

Deadline for submitting bids is 30 May 2005 at 10:00 Oslo time. The spectrum licences will be allocated by a sealed bid auction. No combinatorial bids will be allowed. A guarantee payable on demand (a bank guarantee) must be posted. Apart from annual administrative fees there will be no reservation price when the spectrum is auctioned off.

Lots – the spectrum licences

The 11 GHz band is divided into two spectrum licences with national coverage:

The spectrum licences will be assigned for use for terrestrial radio services on Norwegian land territory, except Svalbard, Jan Mayen and Norwegian dependencies. They will be assigned as rights to use the spectrum until 31 December 2016. The licences are transferable. This includes all types of transfers from leases to regular resale.

The spectrum licences will be neutral in terms of technology. This means that the licensee selects which technology will be used for the spectrum. However, prospective buyers should pay particular attention to the usage restrictions imposed in order to protect end users’ reception of satellite broadcasting services.
